LIONHART Posted July 8, 2004 Report Share Posted July 8, 2004 The Senate is currently considering S.2062, the Class Action Fairness bill. This bill, along with the concealed carry for law enforcement officers measure, were considered to be prime targets for Sen. Dianne Feinstein to use as a vehicle on which to amend her AWB renewal. The CCW for LEO bill passed unanimously in the Senate last night, with no amendments even attempted. This leaves S.2062 as very likely being the last train out of the Senate before the ban expires (the Senate will be out of session from July 26th until September 7th, only about a week before the ban's expiration). Democrats, and even some Republicans are attempting to turn this bill into "flypaper" in an attempt to get a pre-election vote on the pet issues each of them have, many of which would mean nearly certain doom for the underlying class action reform bill. Senate Majority Leader Bill Frist has put his foot down, and insisted he will not let this happen. Despite a compromise offered by Frist, which would have allowed unlimited amendments that were directly related to the bill, and a single non-germane amendment (a measure long-sought by Democrats to increase the minimum wage), Democrats are insisting on retaining the right to use the bill as a vehicle for many more unrelated amendments. Senate leadership says they will not agree to this. Thus, an impasse has been reached on the bill, which, unless one side gives in, can only be broken by a cloture vote (which will force the Senate to move to final passage of S.2062, with only germane amendments being permitted). This vote will likely take place tomorrow, but could come sooner. Forcing cloture on the bill will eliminate any chance of the AWB being added to this bill, and will effectively seal the fate of the renewal effort for the remainder of this session (though we will, of course, still remain vigilant). It will also allow the Senate to proceed to the actual bill, a much needed step in the right direction towards reforming our much-abused civil court system, without the measure being threatened by a slew of "poison pill" amendments. CALL both of your senators TODAY and urge them to SUPPORT cloture on S.2062! It is not even necessary to get into the details about your opposition to the AWB... simply state that you support the class action reform bill, and want to see it passed, not bogged down or killed by unrelated amendments. May come up again today or later (according to my favorite (NOT) senator Harkin's office), NO WAY HE WILL VOTE FOR CLOTURE according to his aid. Don't stop writing your Senators! Even if (And I'm pretty optimistic that the Ban IS dead), the AW Ban does Sunset, we will have many more battles to fight in the future!
