Form 2 pre GCA of 1968 Import of an NFA weapon?

Ok.

I'll try and make it short.

I am in a potential transaction with another SOT that has a weapon on a current Form 4.

In lies the rub. In box 4a it lists a wartime manufacturer during WWII with Inter-American Import/Export Co,

Sacramento CA.

 

All of our pre 68 sales samples have that company listed on our Form 3s.

 

There are many scenarios and no clear information.

 

A FOIA request was started on his end back in January. No info as yet. Form 2 populates on his eFile Form 2.

 

The NFA states the same as the original registration. I do not have any information on the above listed company other than importing pre May sale samples.

 

There appears to be no Import markings on the weapon.

 

The NFA stated that he request a copy of the original Form 2 from them via email. He has not received any information as of yet. Sometimes the information listed on the forms is incorrect and that can make the difference between a C&R and or a pre 86 remanufacture or Manufactured.

 

 

Does anybody have a similar story that may have been clarified and the clarification of transfer known.

 

No money has changed hands.

 

Any and all input is appreciated!

A note, we purchased a Beretta Model 38A post war sub machinegun with a 1949 date stamped on the receiver. Actual model on the Amnesty form was 38A/43.

 

Anyway, we reactived the firearm on a Form 2, checked the correct box. We eventually sold it and transferred it out on a Form 3.

 

We get notification from the NFA that the transfer needs a demo letter to transfer. They did not have any information in the NFRTR pertaining to this firearm. Since we had the original amnesty form, we faxed it to the NFA. Our transfer was approved.

 

This just adds to potential scenarios...

Ok...

 

I did get a response and it was very informative.

 

As I understand it.

 

IA I.E. Co pretty much dealt is pre May sales samples. I found an old SGN ad from 1983 under the heading of AMERX. I understand that was the trade name that they were marketed under.

 

As was stated in one response to our post. Is the fact that IA IE Company stamped their information in hard to find areas. We have one as such on one of our sales samples.

 

It appears that an Edward Faust of Sacramento ran several firearm related businesses dealing in importing all things firearm related.

 

He did operate the Old Sacramento Armory as a FFL holder. The Import business, may or may not have been the only SOT.

 

Knowing Ca. That was most likely the case.

 

Both Title I and II weapons. I was able to obtain this information about 6 months ago.

 

So, with all of this information and including that from RKI on and off the boards.

 

All of the evidence points toward a pre May sales sample.

 

The only kicker, is why is there a Form 2 in the mix?

FWIW.

 

In the upcoming September 8th-10th RIA house has a M37 Saco-Lowell LMG with the Inter American Import Export markings on the front of the receiver on the right side.

 

The weapon is listed as a C&R Transferable weapon. It is my understanding in that Import markings were not required, until the passing of the FOPA legislation...

 

Lot # 3547

BTW...

 

Found out that IA did manufacture some M37 LMGs Most likely a remanufacture or a manufacture from parts kit.

The lot # 3547 in the upcoming RIA event, may be one of the them.

 

With IA IE SAC stamped on the receiver, it should not be classified as a C&R.

 

There have been cases where buyers thought they were purchasing transferable MGs. That ended up being pre may or a non C&R.
