What Would You Do?

Guys, I need some advice from those of you who have encountered delays with the form 4 transfer. ATF cashed my check on 6/10. In october, the form was returned because the Sheriff failed to indicate his title on the blank. The corrected form was sent back 10/10. Haven't heard a thing yet.

 

Do I need to do anything at this point? How much longer should it take?

Personally, I'd at least wait until 90 days are passed, starting at 10/10 since they probably didn't do much more than make sure all your Ts were crossed Is dotted before they kicked it back to you. If you haven't heard anything at the 90 day mark call your examiner nad ask. If that doesn't work you can always call your Congressmen.

 

FWIW I called my Representative and one of my Senators once over a Form 5 screw-up, spoke with one (Rick Boucher), missed a call from the other (George Allen), and had my gun and approved Form 5 back within a week or so.

It should go by the june date. At any rate it is long overdue. I would call at your earliest convenience, talk with the examiner (or leave a message) politely inquiring about the transfer. Make sure to wish them a merry christmas, etc (attract more flies with honey than vinegar!)

 

All that a transfer really waits on is the fingerprints from FBI...i called on a transfer several weeks ago, examiner put me on hold for 3 minutes and in the mean time approved two transfers!!

Any glitch with the paperwork will always cost you an extra month, or two, of delay. Always tripple check forms before sending them in. CLEO offices are notorious for their incompetence in providing the minimal information under the correct spaces. You should immediately call ATF to check on the pending status. I had a no glitch Form 4 this year take 80 days from time ATF cashed check. But 13 years ago, I had a Form 4 take 114 days because the Class III dealer screwed the pooch on the Form.

From the day that I mailed my Form to the day I receieved it back, approved, took only 83 days. That doesn't help you but with all the info from our responses you get the idea that the transfer doesn't take that long. I would think that the process would start all over again from the time you resubmitted your form in October; about 90 days from that point. What do I know, that was my first transfer.

SGT. PRE 9-11 I HAVE GOTTEN A TRANSFER BACK IN 31 DAYS, END OF LAST YEAR WHEN JUSTICE DEPT. TOOK OVER I HAD 2 PENDING KICKED BACK AND HAD TO START ALL OVER AGAIN WITH THEIR NEW FORMS TOOK 4 MONTHS. SOMETIME IT DEPENDS IF A WELL KNOWN DEALER IS INVOLVED...THEY SEEM TO GET THINGS DONE FASTER.I RECENTLY HAD ONE FOULED BY THE DEALER ENTERED WRONG SERIAL NO ... HE GOT IT FIXED IN 3 WEEKS.GO FIGURE. You can count on delays this time of year. Lots of folks in the bureau are taking leave for the holidays and other people get in the holiday slowdown mode. Smoker and the others are correct. Have patience and once it gets over 90, start calling. My transfer took about 100 days and I work for 'em.

I think you should always call after 30-40 days to see if it has reached pending status. Hey, these are government employees who surely have the time to answer a phone and check a computer. Phoning ATF is not an imposition for them, and surely does not suggest impatience on your part, only justifiable concern.

Call and ask to speak to the examiner, you can ask to be transferred after you have requested status of the transfer by giving the serial number and the parties involved in the transfer.

 

Best to call before 0900 DC time, be nice and ask if there is anything you could do to expedite the transfer. Give them a story to make them believe you are human. Like you and your father are anxiously awaiting the transfer so you can let your father hold one just on last time before he passes. “You know he carried one just like it on D-Day when he stormed the beach”.

Good luck I know what you are going through, my first transfer took about a year, they had the wrong model number on the form 4 and then it got lost in the mail after the second try!

The stupid bastards forgot to put a stamp on my last transfer. Remember these people have SO MUCH TO DO! Whatever! Still, my problem is not corrected. I understand there is a regulation that says 90 days, and on the transfers they have done, its usually less than that on the date shown.

 

Who knows. The NFA thing needs a HUGE revamp.

Guys-

Thanks for all the input. That was very helpful. I'm also glad we have T-man, who is able to give some insights on the Bureau. Good to know that others had these kinds of delays, so I won't feel too special.

 

My dealer gave ATF examiner a call, but was unable to reach him/her. The operator would only say that it is pending. Apparently, their computer doesn't have details, beyond when the form arrived. I'll give it several more months before I pursue it.

Just in case, the NFA in DC is at #202-927-8330. Talk slowly in a polite voice, be humble, kneel down, cry ... you get the picture.

 

I have two transfers pending. They are almost 90 days. I did a transfer from me to an out of state dealer and that took 14 days. Go figure!
