I have two questions about the transfer of a TSMG (Colt '28 Navy) from the Transferor directly to a C & R license holder in an INTERSTATE transaction:
1. In order to transfer the gun as a C & R directly to a C & R license holder, would the Transferor's Form 4 have to identify the gun as a C & R in the description box; or
2. Would the gun be approved by the ATF as a Form 4 transfer directly to to a C & R license holder simply because the manufacturer is still listed in the Form 4 Description box as Colt/Auto-Ordnance without additional manufacturers' names added?

Question About Form 4 C & R Transfers

Jay: If the gun, as described by manufacturer and model on the form, is listed in BATF publication AFT P 5300.11 as being on the Firearms Curios or Relics List they will approve transfer directly to the C&R license holder. The form does not state "C&R" on it to describe the firearm.
