Yep, you got it! The NY ban attempted to mirror the federal AWB. In NY we will not be able to possess the new hi cap mags or the new guns with all the features either. This does pose a enforcement problem IMHO. New guns can be traced to when they were produced...but...if there are no other markings or other identifying features added to the drums...how would they be able to tell? It is not like our Police officers all know the laws ins and outs cold either. On the possible lighter side...Artical 265 of the NYS consolidated penal law entitled "Firearms and other dangerous weapons" says, in my interperetation, that the term "assault weapon" does not include "a semiautomatic rifle, a semiautomatic shotgun or a semiautomatic pistol or any of the weapons defined in paragraph (d) of this subdivision lawfully possessed prior to September fourteenth, nineteen hundred ninety-four." I beleive that the federal law exemtps pre ban guns that were in that configuration BEFORE the ban...that is to say you cannot add a feature to a preban gun that was not present before the ban...the gun had to be complete or in kit form with all the features to be grandfathered. My read of the NYS ban say the TERM DES NOT INCLUDE GUNS POSSESED BEFORE THE BAN. I take this to say that as long as your gun was possesed before the ban, that once the federal ban expires, you can add the features you want. For example, a preban MAK90 can be fitted with an underfolder and all goodies as long as federal section 922® is observed. I would think my neighbor would put that collapsible stock on his sp1 right away.
Please do not take this as legal advice for I am not a lawyer and do not play one on the web or TV! Hopefully one of the more knowledgeable memebers of the board can shed more light on this.

Does New Yorkistan define weapons that are "not dangerous"?!

Maybe you guys in New York should stock up on "non-dangerous" weapons before they outlaw those also!

It is just our cross to bear for living here. Unfortunately, in this state, there is a remarkable misunderstanding on the right to keep and bear arm. I recently educated a local K9 officer (childhood friend) his wife (father is former chief of police) and his father (who is a city court judge) about the free 34 or so states that allow registerd machine guns. The idea was completely foreign to the lot of them and they said the idea "took some getting used to". We are brainwashed here from all angles and the mention that you may have a thompson, ak or ar15 even in semi makes people cringe. We all know that AK47 varients are cheap and plentiful even here. You can go to the local sporting goods store and buy one. The fact is they are everywhere and you rarely hear of them being missued. I think education is the key here. We have to dispell the ambiguosity (if thats even a word and spelled right) of firearms before we can gain an inch. Our leaders can have anything they want...but do not want you to have it. I guess the average Joe is not trustworthy enough to have such power. Were would we be without such blessed, benevolent politicians to dictate our lives while they live thiers anyway they want. just my 02. Rant off.

All I can say is that I am glad that I don't live in NY (or CA).
I live in TN (Memphis). Here, can we can own anything in the relm of NFA (after the ATF approves it.)
Also, the whole south-eastern area of the country has conceled carry permits for hand guns AND each sate observes the other states permit as being valid. I can carry my hand gun in TN (my state of residense) or MS, AR, AL, LA, TX GA, FL, and others (Maybe KY.)
Maybe the south isn't so dumb after all!

Unfortunately I have a gut feeling that you are right..

The "new" law, "if", and "when" it hits is going to be a nasty one.
I have a sneaky feeling that it will be voiced in the area that what you have you are stuck with and the only recourse is to the melting pot.
Like I mentioned in an earlier post the battle has just begun. Now we will need to be even more aggressive with our writing and calls. It's going to take a much tighter group, with a unified goal.
Perhaps a grouping of MG related clubs such as TCA. As the NRA doesn't guard our fraternity as closely as the "sporting guns".

Thank god that there are other states out there that recognize the constitution for without them the whole country would be infested with this rot just like NY. There are a few other organizations out there for us other than the NRA though. In NY there is Scope NY and the New York State Rifle and Pistol Association. However none of them gives a crap about class 3 items. I am affraid we are done forever in NY for them.
As important as it is for those of us in oppressive states to stand up for our right to keep and bear arms...it is just as important, if not more, to stick together and stand up for all of our rights...we can't afford to loose any footholds that we have.
Count me in against Schumer and thanks but I will have to pass on Hillary...my morals forbid me to lay with swine!

You forgot Virginia in your list of states that will recognize your TN permit. My VA permit is good in your state too.
