BATFE Form notifying intent to move home address with NFA items

"This form is used to obtain permission to temporarily or permanently move your registered National Firearms Act (NFA) machine gun, short barreled rifle or shotgun, or destructive device interstate. Persons other than qualified federal firearms licensees (FFLs) or government agencies are required to obtain this permission."

 

Another good reason to obtain our C&R FFL, if you have not yet done so.

I may be mistaken but the C&R license holder is limited to transporting C&R firearms interstate. If the Machinegun or other NFA firearm is not a C&R then a Form 5320.20 needs to be approved.

The ability to transport C&R NFA MachineGuns interstate is one of the C&R license benefits.

So if you have a C&R and you make a permanent move to another state which allows Machineguns you do not have to fill out anything in the way of forms. But if you have another MG that is not a C&R you are also taking with you, you must fill out a form?

All I know is when traveling interstate with C&R Machinegun and registrant holds a C&R FFL no 5320.20 is required. A 5320.20 is required for a C&R FFL holder traveling interstate with non C&R NFA guns.

 

No idea on a permanent move. Apologies to the original poster for muddying the waters.

However, if you permanently move to another state or location you should update your records with BATFE. If not when you go to sell the firearm you risk having the form 4 sent to the incorrect address.

And the permanent move must be approved in advance. The ATF gave me pure hell in 1992 when I moved my C&R without their permission. They didn't care that Hurricane Andrew devastated South Florida and the Air Force took four months to decide to close Homestead and send me somewhere else. They came close to revoking my FFL.

So you would need to file a Form 5320.20 ahead of time for each of your guns before you actually make your move to a new residence. Makes, sense however I wonder how many owners are actually tardy in doing so. Does one receive a paper response from ATF on each gun to confirm a change of address has been made?

Mike, I didn't have any NFA at the time, but they sent me a copy of the form marked as approved. I believe you must submit a form for each NFA item, so I would expect you'd get an approved form back for each.

 

OTOH, I'm married so I'm not allowed to think!

You receive your copy of each form back approved which is how you assume they've retained/entered your new information correctly. As to the timing, well, there's mail forwarding, faxing, emailing, etc. as ways to keep up or expedite forms. Sometimes you just gotta go when you gotta go and waiting for government is not an option.

I've filed retroactively once and not had any issues, and I know others that have as well with no issues.

Most people misunderstand the basic concept of the form. It's not a "permission slip", it's a notification and theoretically keeps stupid people from saying they are going to move to New York, they file the form, and are shocked when it comes back "disapproved"?
