firearm Posted March 11 Report Share Posted March 11 (edited) ATF called last week asking me if I had a Hurley gun in my inventory that someone transferred to me 37 years ago. No, I do not and never have. He emailed me a copy of the approved form 3 with my name on it and said there was a form 3 approved to another class 3 dealer with the same serial number about the same time. After a couple of days of research, I found that it was a typo on the form 3 by the dealer in San Antonio that was never voided. In any case, I called him back, and we worked it all out. I hinted how screwed up the BATF was in DC back then and he concurred. While I had him on the phone, I struck up a conversation pertaining to Pre-86 samples becoming transferable and he said that was true. I asked him about a factory Pre-86 HK MP5K that I kept all these years, and he confirmed that it was now classified as transferable. Nice stroke of luck. Not many of these around. I still probably have about 20 or so Pre-86's in stock so maybe I will get lucky again. Also speaks as to why so many class 3 dealers have been calling me wanting to buy Pre-86 samples over the last couple of months. I originally had four to change, but after a few days two reverted back to pre status. Now I see that one of my MP5's has changed, whoo-hoo! "• Is the imported machinegun transferable? • It depends: – Was the machinegun lawfully imported on an ATF Form 6 and registered on an ATF Form 2 before May 19, 1986? – Was a Form 5 approved transferring and registering the machinegun to the government customer upon importation? – Upon approval of the Form 5, was the machinegun transferred to the government customer for official use? • If the answer to all three of these questions is “Yes,” then the machinegun is transferable."
