Regarding HR2038 I received a letter from Sen Alexander after the last time I called in about not attaching this to any Liability Limit Senate bill should it pass the house. Once that was voted down, I understand it got buried in committee sometime in June under some vague terrorism connection. My wife used to work for a former Texas Senator, and her opinion is once it gets buried in committee, it is almost impossible to get the same bill on the floor for a vote.

 

This not to say it can't haunt us in another bill, as McCarthy is determined to get something passed that will get revenge on us gun owners. We all have to be vigilant and watch for signs of any anti-gun activity. The Feinstein crew are hoping to catch us like lobsters or frogs in the pot; gradually heat up the water so no one realizes what is really going on, and hope we'll stay in and get sleepy and get cooked.

When you say it got buried in committee, are you saying that it got voted down? I remember us discussing this one as something that would pop back up as a backlash to the AWB sunset. Do you think it didn't get the support because it was too comprehensive? If that is the case, I wonder how they will try to package it next time.

Just a little nervous here about these bills and such. Much protection is needed by all of us. Bush certainly isn't out to assist any of the gun owners but choices aren't very good either.

 

I think we should nominate and financially support LaPierre for the presidency.

 

Semis registered under the NFA might fair a little better, but then again it places us right up front in the top drawer, with the possibility of even tighter control.

 

The battle has really just begun!

Buried in committee (House Judiciary Committee) means the bill has been "referred" for supposed further review (We're not saying no to it, we need to examine it and consider further). Let's face it, by the time a bill has been voted on, the actual consideration is done! One only reason it would go back to committee is to shelf it and it disappears. The other reason is if it is being modified- in this case though, both the House and the Senate would have separate bill #'s . The bill it was being attached to was S2062 and there were not enough votes toeven bring it to the floor. I spoke with both Frist and Alexander's offices all through this year over this and was assured they are interested in being re-elected, and the majority of the information they get from constituents in Tennessee is that gun control is not welcome here. I only wish it was the same all over.

 

Walter, there's lots of cheap land in Tn-you can even own a MG if you want to!

 

We have to be the loudest voice Washington hears. Whoever makes the most noise will get their way. I personally think a gunshot is louder than a soccer mom with laryngitis. So I'm making sure my reps in Washingtoon understand that to get my vote in November, they have to vote my way on the floor.

Junglewalk, and to think I moved from Georgia to Washington state. The state of'Constructive posession' a crock if I ever heard one.

 

I'm currently limited to building the most nefarious, intimidating and evil-features-laden rifles I can find. So far, I'm building an AMD 65 PISTOL hehe, a rifle with a fully functional folder, both all black of course, and a gorgeous, mint and matching StG58 Fn/Fal, the model maude by Daimler/Puch /Steyr for a very short time with the full barrel length, flash hider, and bipod w/ a hinged SAW stock that has the buttplate over the shoulder.

 

I read something very interesting the other day that I wanted to share with all of you. Evidently the 9th Federal Circuit Court of Appeals laid down a ruling that if you are in posession of a machine gun, of your own maufacture, within your state, and a completed weapon, or receiver hasn't been used in 'interstate commerce' the ATF have no jurisdiction, therefore it's not a crime. If your state allows machine guns, pursuant to federal law, you are exempt on both counts. The 'piggyback exemption' in laws that defer to the fed. And once there is a ruling on appeal, well that's it. Especially at the federal level. This was ruled in 2003, by the way. The date is November 13th, the case is here:

According to the court, the GCA 68 prohibited the interstate shipment of unregistered machine guns. The clause, was under 'affecting interstate commerce'. There is a four-factor 'Morrison Test' that has to be affirmed on all four counts, this case met none, due to the fact that the defendant (Stewart) had manufactured his own receiver and made something of a 'unique design' per the ATF technician. That not withstanding, the 'uniqueness' has nothing to do with the Morrison Test, as this party was neither engaged in the 'commercial manufacture' and consequent use of interstate commerce to further same.

 

As far as I'm concerned, this is a Godsend ruling. Especially in Sacremento, California! The California jurists have time and time again tried to whittle away the rights of the 2nd amendment. This is a stunning victory for private ownership of virtually anything on the BATF hit-list provided you make it yourself. Read the court case and let me know your thoughts. I'm somewhat of a 2nd amendment activist myself, and want to see the laws here in Washington state (part of the 9th circuit) changed.
