Class 3 Guns

When you own a full auto Thompson (on a form 4) in one state, and you move to another NFA friendly state; how do you go about moving the gun's registration from your old state of residence to the your new state of residence?

 

How many tax stamps have to be paid?

Others on here are more knowledgeable but no additional tax stamps are required. They are one time for each weapon until sold. As far as the move goes I believe you are required to notify BATF in writing of your new address. Of course I'd include the old addresses and the serial numbers of your NFA weapons.

 

Interesting, they could care less about the Manufacturer or the Model, they deal with serial numbers only. A year or two ago I called BATF to check on several NFA's and what forms they were currently on. Only gave them the SN's and they told me what they were and who owned them.

You will need to subit ATF Form 5320.20 for any NFA items you own, and get the approval before you move to your new residence. On the form you check off that the firearms are not to be returned to original location, and note that the reason for transportation is "Change of residence".

 

The form is available free from the BATF.

 

No tax is required.

Yes, that's true, however, if Norm is moving he still has to notifiy the NFA Branch of the new permanent storage location of the registered firearms. That can be by formal letter or Form 5320.20.

However, when you change your permanent address with the C&R you will need to file a form 5300.38; Application for an Ammended Federal Firearms License

I think you would have also had to use the C&R to aquire the gun.

I guess I should have been more specific.

 

The Thompson is NOT C&R. Also, I have an SBS.

 

What if I move to a state that is not NFA friendly? Can I still own these guns and have them stored somewhere else like my mother's house; she lives in Mississippi (an Nfa friendly state), or will I be forced to sell them? http://www.machinegunbooks.com/forums/invboard1_1_2/upload/html/emoticons/sad.gif

That's pretty rough to have to move into another state to retain your job (and to think that I have had problems justifying moving to Idaho to have Class 3 toys) especially you might have to loose your "toys" doing so..
