October1971
In 1974 the BATF came to my office in Florida with a letter requesting I voluntarily surrender a registered M14 rifle. I was young and dumb and didnt ask for a copy of the letter they showed me at the time. (They were taking the position that even though it was amnesty-registered, they could file Civil Action to recover what they considered was stolen govt property. Since I had already transferred it to another class 3 in south floor, I couldn't comply with their request.) After all these years I'd like to have a copy of that letter. But I am no longer the registered owner. Is there a way I can do a FOIA in which I ask for that secific document, even though I'm no longer the owner. TIA I think you could try a FOIA as the letter you seek is not a tax record, strictly speaking, but the .gov may not be able to find the file. Do you still have the serial number? Sig
Bill I agree with philasteen that the document you seek is not strictly speaking a tax document. BUT anticipating our .gov my thought is they will treat the document IF it still existed as part of the tax file for the weapon in question. Better choice if you happen to know or could trace down the current owner is to ask that individual to give permission to see all records or make the request and then share the result. michael oh wanted to add Gordon Herigstad obtained several FOIA documents by obtaining permissions of individuals to release information to Gordon. October1971
Thanks for the replies. Yes, I have the serial #. But the guy I traded it to lost all his class 3 stuff, in his 3rd divorce...! So I don't know where the piece ended up. I know the head guy currently in the Tampa ATF office, who was just starting out as a young agent at that time. If they kept the letter in a file on me in Tampa, maybe I could entice him to find it? What if I specified in the FOIA that I am not wanting ALL the info on this serial #, but only the correspondence etc. during the time I owned it? Thanks again for your valuable input, as always.
