Thanks to your efforts, the Clinton semi-auto ban is about to expire.

 

 

The ban on magazines and firearms -- passed in 1994 -- represents one

of the most hated pieces of gun control ever enacted. But with less

than two months to go (and Congress being in recess most of that

time), the ban is scheduled to sunset on September 13, 2004.

 

Anti-gun Senator Dianne Feinstein, however, is not giving up and is

pushing hard to get the semi-auto ban tacked on to some other bill.

 

So far, you have been instrumental in bolstering the resolve of a few

key Senators, who have managed to thwart Feinstein's every move and,

thus, keep the semi-auto ban from getting to the President's desk.

Consider what you have accomplished in recent months:

 

* In March, you encouraged Senators to kill a bipartisan bill that

had become loaded down with anti-gun amendments -- riders which

included the semi-auto gun ban. Senate Majority Leader Bill Frist

could have used parliamentary tactics to disallow all gun-related

amendments, but he specifically rejected that strategy. The

underlying legislation, which would have helped to protect gun makers

from frivolous lawsuits, fell under the weight of your activism

against the anti-gun riders.

 

* Most recently in July, your efforts resulted in Senator Frist

using the very parliamentary tactics that he had rejected only a few

months earlier. This time, grassroots pressure convinced him to

block the semi-auto ban as an amendment to the class action bill (S.

2062).

 

Now, there are less than a dozen legislative days left. And the gun

banners are "pulling out all the stops" to get this bill passed.

 

The focus of their ire is being directed at Senator Frist, since he

was instrumental in keeping anti-gun amendments from being offered to

S. 2062. One anti-gun website is calling on its readers to "flood

Dr. Frist's office with tens of thousands of e-mails telling him to

stop blocking the Assault Weapons Ban renewal."

 

They are also calling on fellow gun banners to pound House Speaker

Dennis Hastert's office with calls to renew the ban.

 

So here's the bottom line: We are winning. The clock is ticking and

the Clinton ban will soon die. But the battle is not over yet! The

other side is playing its ultimate trump card -- the friendly liberal

media -- and is reaching deep into its war chest.

 

Major newspapers are running anti-gun editorials in favor of renewing

the ban. Former Presidents are lobbying Congress with the same

message. Law-enforcement bureaucrats are issuing sound bites in

cities all across the nation.

 

And Hollywood types such as Dustin Hoffman, Robert Redford and Barbra

Streisand have written a letter to the President, urging him to

extend the ban for 10 more years.

 

There is an all-out effort by the other side right now, and we need

to make sure that we are NOT silent. We need to keep the pressure

on.

 

Like the Phoenix, the gun ban renewal could arise out of the ashes at

any time. After all, both presidential candidates SUPPORT the ban.

Both Kerry and Bush have indicated they want to see the ban renewed.

 

And even though Majority Leader Tom DeLay has thus far managed to

keep this bill off the floor of the House of Representatives, he is

being threatened by a politically motivated prosecutor in Austin.

His tenure remains in question for the time being, which means that

we, gun owners, must remain eternally vigilant!

 

ACTION: Please urge your Representative to OPPOSE the renewal of the

semi-auto ban. Remind him or her that this is an election year and

that strident calls from the Brady Bunch in the liberal media do not

decide elections! Here’s what you can do:

 

1. Use the pre-written message below and send it as an e-mail by

visiting the GOA Legislative Action Center at

http://www.gunowners.org/activism.htm (where phone and fax numbers

are also available).

 

2. Remember also that since all members of the House are up for

reelection -- and Congress is due to take a long summer break --

chances are excellent that you can confront your Rep. in person

during the coming weeks. Don't miss an opportunity to do so.

Dear Representative,

 

I have noticed an alarming and well-coordinated campaign within the

mainstream media recently regarding the expected sunset of the

semi-auto ban. It is imperative that you not fall victim to the

scare tactics -- that instead, you do the right thing and make

certain that the semi-auto ban dies its well-deserved death.

 

Anti-gun forces are trotting out law enforcement bureaucrats, former

public officials, Hollywood stars, and anyone else they can find to

decry the Bush administration's "lack of action" in calling for

Congress to immediately reauthorize this odious gun ban.

 

Truth be told, those gun grabbers are scared -- they know the

American people have thrown out numerous U.S. Representatives in the

past for voting to outlaw these common semi-autos. With a mere

handful of legislative days remaining before the ban sunsets, they

are doing the only thing they can -- working feverishly with their

friends in the liberal media, hoping that press coverage alone will

spook you into getting aboard the gun-ban train.

 

I urge you to stand fast. The sky has not fallen, and it will not

fall on September 14th. No matter how loud the disarmament crowd and

their lackeys in the press scream, these simple weapons have never

been the choice of criminals and never will be.

 

The ban should sunset, and no pro-gun Member of Congress should fear

for his or her seat as a result, since media hype does not translate

to defeat at the polls. If the media decided elections, Ronald

Reagan would never have been President.

 

Hold the line. Better, remind your pro-gun constituents that you are

publicly willing to state that this useless and pernicious law simply

needs to go away.

FBI MAKES PROGRESS ON GUN BUYER PRIVACY

 

One of the top priorities of gun owners at the end of the Clinton Administration was to end the unlawful retention (for up to 180 days) of records on lawful gun buyers, kept by the FBI`s National Instant Background Check System (NICS). Though the law establishing NICS has always been clear that all records of a sale should be destroyed when the sale was completed, the Clinton Administration claimed the records were needed for "system audits."

 

In July 2001, the Department of Justice published a proposed regulation that would require record destruction by the beginning of the next business day. NRA, along with hundreds of concerned citizens, filed comments on the proposed rule.

 

More recently, the Tiahrt Amendment to the Fiscal 2004 Omnibus appropriations bill required destruction of these records within 24 hours--not perfect, but a huge improvement over the original Clinton-Reno plan. With that legislative language going into effect this week, the FBI also published a final rule implementing the same 24-hour requirement. The FBI`s explanation of the rule carefully rebuts many of the arguments anti-gun groups had leveled against this critical privacy safeguard.

 

The new rule also makes other important changes to NICS operations. Perhaps the most significant change for the average gun buyer is the creation of a "Voluntary Appeal File." Under the new rule, a person who is wrongly rejected for a gun transfer (in a case of mistaken identity, for example) and successfully appeals the rejection to the FBI, can have the information from the appeal stored in the system, thereby avoiding the need for unnecessary appeals in the future.

Congress is currently on its Summer District Work Period and will be out of session until September 7. That means that the gun-banners have just a few more working days left to push "assault weapons" legislation if they hope to get a vote before the September 13 "sunset" of the Clinton gun ban. With time running out, the anti-gunners and their media sympathizers are in a frenzy. They`re becoming desperate, and we must remain vigilant against any attempts to reauthorize this legislation. We can expect these gun prohibitionists to mount a major offensive battle, and now, more than ever, it is critical that we remain active!

 

During this recess, your Senators and Representative will be back home in their respective states and districts. Many lawmakers use this time to hold town hall meetings, where they can report on what they`ve been doing in Washington, and take questions from their constituents. These meetings afford you an opportunity to personally voice your strong opposition to any legislation that seeks to reenact or expand the 1994 Clinton gun ban.

 

Please contact your lawmakers` district offices and ask when they plan to hold their town hall meetings during the break. UTAH HIGH COURT RULES

 

Self-defense took a big blow this week when the Utah Supreme Court upheld the right of America Online (AOL), America`s largest on-line service provider, to fire three employees whose firearms were stored in the trunks of their cars in the parking lot of an AOL call center in Ogden, Utah. In a decision that diminishes rights guaranteed under both the Utah and the U.S. Constitution, the court acknowledged the individual right to keep and bear arms, but said the right of a business to regulate its own property is more important!

 

Complying with this decision could potentially cost an employee his or her life--violent criminals certainly aren`t going to obey such a ban. It may also diminish employees` abilities to hunt or target shoot after work.

 

The issue is becoming a hot legislative topic in the states. This year Oklahoma passed HB 2122 ensuring that employees with guns in their cars were not fired or harassed, and it was debated in several other states.

MARYLAND BEAR HUNT

IN DANGER OF BEING CANCELED

 

Over the last decade, the black bear population in Western Maryland has dramatically increased, with nearly 400 bears now living in that area. The large increase has led to the development of a responsible population management plan by the Maryland Department of Natural Resources (DNR) in the form of a limited bear hunting season. Although this is the most effective way to manage the bear population in Allegany and Garrett Counties, many anti-hunting advocates are putting pressure on state legislators to cancel the hunt.

 

DNR`s black bear management plan will soon be considered by Maryland`s Joint Administrative, Executive, and Legislative Review Committee (AELR). The State Senators and Delegates listed below are members of the AELR Committee and need to hear from NRA members. Please take a moment to call the legislators listed and let them know that the management of Maryland`s black bears is best left to the scientists and biologists at Maryland`s DNR, and that the black bear hunt scheduled for this fall should proceed. This week, Governor Ruth Ann Minner (D) signed into law House Bill 164, the NRA-backed range protection bill. The law, which protects existing shooting ranges and hunting operations from nuisance suits that might otherwise be brought by persons who have recently moved into the area, was approved overwhelmingly by the Senate and House of Representatives earlier this month. NEW YORK

On July 21, the New York State Legislature reached an agreement to remove language banning .50 caliber rifles from anti-terror legislation. After A7039, a stand alone measure outlawing .50 caliber firearms, met with little support in the Senate earlier this year, Assembly Speaker Sheldon Silver (D-64) included the gun ban as part of the two-year struggle to pass anti-terrorism legislation in New York. Washington, DC - There are only six days left when Congress is in session before the expiration of the Assault Weapons Ban - a law that President Bush pledged he'd renew as a candidate for President in 2000. ''It makes no sense for assault weapons to be around our society,'' he said then. And another Republican leader made statements this week indicating the President can get a vote by simply asking for one.

 

"President Bush is blocking a vote on the Assault Weapons Ban," said Michael Barnes, President of the Brady Campaign to Prevent Gun Violence united with the Million Mom March.

 

Here's a brief review of published comments since May. First, on May 12, The Hill newspaper wrote "an aide to House Speaker J. Dennis Hastert (R-Ill.) has said privately that if Bush pushes for it, the ban will probably be reauthorized. But if he doesn't, the chances of legislation's passing this year are remote."

 

Then, on June 24, the Boston Globe reported "Ken Lisaius, a White House spokesman, said Bush still supports the ban, but is waiting for the House to act."

 

Then, on July 11, the Washington Post reported the House Majority Leader Tom Delay said "we stated our position before the White House had to ask us... [the White House] "knew not to [ask,] because the votes are not there."

 

Now, following a news conference held by Congressman Michael Castle (R-DE) and Congresswoman Carolyn McCarthy, Delay told the daily newsletter Congressional Quarterly "there's no reason to use floor time for a vote just to have a vote on this particular subject," he said. "And unless directed otherwise, I see no reason to bring it to the floor."

 

The Assault Weapons Ban has enormous bipartisan support across the nation. A poll released last week by Penn, Schoen & Berland showed 66 percent of Republicans, 75 percent of Democrats and 79 percent of independents supported renewal.

 

Here's one that should make everyone feel real good.

Local cops won't miss assault weapon ban set to expire

 

LAKE/PORTER COUNTIES/ILLINOIS: Most gun manufacturers found restrictions on semiautomatic weapons easy to circumvent.

Big shots in the national gun-control debate may party or hang out black crepe paper Sept. 13, when a 10-year ban on assault weapons is expected to end.

 

Area law enforcement officials expect it to be just another day on the streets.

 

"I think it makes most police officers uncomfortable knowing the amount of fire power that is out there and available to the percentage of the population that would use it for evil purposes," said David Lain, chief deputy of the Porter County's Sherrif's Department.

 

"But I don't see that, ban or no ban, that it's going to affect what weapons the bad guys are able to get ahold of."

 

The ban, enacted by former President Clinton in 1994, made it illegal to sell 19 semiautomatic rifles, pistols and shotguns. They hold more than 10 rounds of ammunition and, once fired, instantly reload the next round.

 

Clinton said such weapons were attractive to criminals because they could expel large amounts of bullets with extraordinary speed to overwhelm armed targets such as rival criminals -- or police officers.

 

The law exempted guns manufactured before the ban and others that lacked military configuration attachments. It was designed to expire, or sunset, after 10 years unless the U.S. Senate, U.S. House of Representatives and President George W. Bush approve its extension.

 

That is unlikely, Katherine Bensen-Piscopo, a spokeswoman for U.S. Rep. Pete Visclosky, D-Ind., said. "The Senate did pass the extension, but it doesn't look like it's going anywhere in the House now."

 

Federal law still bans fully automatic weapons that fire as long as the trigger is depressed or until empty. A number of states have bans on assault weapons that will remain in effect after the Sept. 13 sunset deadline for the federal law.

 

Indiana, which is considered a permissive state as far as gun regulations are concerned, doesn't have such a ban. Illinois is a more restrictive state, and the city of Chicago bans most privately held firearms.

 

Earl Westforth, owner of Westforth Sports Shop in unincorporated Calumet Township, said only a tiny percentage of these firearms end up in the hands of killers.

 

"(The ban) takes away from the guys who really enjoy it, like a car capable of going 140 or 160 mph," Westforth said. "You don't need (the speed), but some people just want it because they have the money to afford it."

 

The Brady Campaign, a gun-control lobbying organization, protested the ban's demise, saying it represents "mass produced mayhem," and that the ban's "loss would be a serious blow to public safety."

 

The view from local law enforcement is less passionate.

 

"I haven't seen that the ban has made much of a difference," Jeff Wells said. He is a 15-year veteran of the Lake County coroner's office, which processes about 80 homicide scenes each year in which firearms are involved.

 

He said the number of victims riddled by semiautomatic weapons are rare. "I remember one case three years ago where three kids were killed in a van in Hammond. There were a lot of bullet casings at the scene," he said.

 

Gary police say an SKS-type assault rifle firing 7.62 mm shells was used to kill four people last January. That weapon and those shells have the capability to penetrate body armor used by police officers, according to the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives. However, SKS assault rifles are not covered by the ban.

 

Hammond Police Chief Brian Miller said gun manufacturers also quickly got around the ban by modifying the military configuration of the banned guns and marketing them as sporting weapons.

 

"Our SWAT team has them. I have one in the trunk of my car. We've gotten them from off the street, too," Miller said.

 

Mike Higgins, a spokesman for the Lake County Police, said officers occasionally will confiscate a Tec-9, a banned semiautomatic pistol that carries 10 to 50 rounds of ammunition.

 

"The Tec-9 is easier to conceal than an assault rifle, but we probably (see) one a month, some months." He said most firearms found at crime scenes are single-shot handguns.

 

Visclosky supports keeping the ban, Bensen-Piscopo said. "He also supports the right of hunters to have guns and he has a lot of friends who are avid hunters, but he has never met a hunter who needs (an assault weapon) to hunt deer," Bensen-Piscopo said.

 

Mark Leyva, a union carpenter running against Visclosky in the fall general election, said, "I want this to end. I believe a ban is wrong because of the Second Amendment-protected right of law-abiding citizens to bear arms."

 

Kelly Hobbs, a spokeswoman for the National Rifle Association, couldn't agree more.

 

"We have seen in every study conducted ... that this hasn't had any impact on crime and these firearms were barely used in crimes before the ban," Hobbs said.

 

"This was a political issue rather than anything constructive. For people outside the Beltway, this is not a top priority for them and members in Congress realize that."

Catnipman, I think they may have meant "semi-auto" (one trigger pull, one round fired). The non-gun savvy people I know think "single shot" means semi auto, and semi auto means machine gun (they don't know what semi means and just see "auto"). Once again, to the closed, mind, igonrance is bliss while to the rest of us, it is just idiocy. I wish there was way to make $ on that level of stupidity- we'd all be rich!!!
